General Terms and Conditions

Andres Villamizar Ardila: Salzburg Paragliding offers and organizes tandem paragliding flights subject to the following terms and conditions:

 

General

1. Some of the flights are taken over by self-employed tandem pilots. In this case, these tandem pilots are the service providers and contractual partners of the passengers. The operator/pilot on the flight ticket (contract of transportation), which must be completed by each passenger before the tandem flight, is considered the organizer and contractual partner.

 

2. If the flight is not operated by Andres Villamizar Ardila: Salzburg Paragliding, the service provider/pilot named on the ticket is liable. Andres Villamizar Ardila: Salzburg Paragliding is liable for the selection of a professional and state-certified pilot, but not for the performance of the tandem flight itself.

 

3. The transportation of people with the tandem paraglider by Andres Villamizar Ardila: Salzburg Paragliding is subject to Austrian law, in particular the provisions of the aviation law.

4. Before starting the flight, the passenger (in case of children, a legal guardian or an adult accompanying person) must read the contract of transportation and confirm it with his signature. By doing so, the passenger confirms he has read, understood and acknowledged these provisions of the contract of transportation and the GTC. This means the air transport contract is concluded between the passenger and the pilot. The statutory provisions in Austria for commercial passenger transport also apply to this tandem flight as agreed.

 

5. Provisions of the transport contract:

(a) Generally

The pilot will determine all the details of the flight. The pilot reserves the right to change or postpone the time of take-off, to change the place of take-off, to modify the planned route or time of flight, or to cancel the flight if meteorological, technical, legal or other unforeseen reasons so require.

 

(b)  Conditions of participation: Obligations of the participant to cooperate.

 

The passenger affirms to be in good mental and normal physical health and agility.

 

The passenger is obliged to inform Andres Villamizar Ardila: Salzburg Paragliding and the pilot if there is an increased risk of injuries during take-off, flight and landing due to their state of health.

The following are to be reported: Limitations in the musculoskeletal system, cardiovascular diseases, nerve diseases, injuries to the spine, as well as high blood pressure, organ diseases or mental or psychological impairments.

 

If any doubt about the fitness to fly, the passenger must inform about their fitness to Andres Villamizar Ardila: Salzburg Paragliding and the pilot (Service provider).

If the passenger is under the influence of alcohol or drugs, the contract is automatically canceled.

 

The passenger must confirm that their body weight falls within the range of 20 kg to 115 kg.

 

The passenger must follow the pilot's instructions throughout the tandem flight. Including preparation for take-off, take-off, in-flight and landing. To be noted for Take-off, the passenger must continue to run until the paraglider has taken off and must not stop running until requested by the pilot. The passenger must inform the pilot if the theoretical instructions have not been fully or partially understood, or if the passenger is unable to follow the instructions for any reason.

 

Passengers are advised to wear sturdy shoes with good grip and suitable weatherproof, windproof, and tearproof clothing. The pilot will provide the necessary flight equipment, including a helmet and passenger harness.

 

For safety reasons, passengers are not allowed to bring any objects with them during the flight, including their cameras.   Passengers are responsible for securing any other valuables they have brought with them to ensure they cannot be lost during the flight.

 

 

(c)   Liability conditions:

The passenger participates in the activity at their own risk. It is advised that participation may result in an increased risk to their health, life, and property.

 

Passengers confirm that they possess personal insurance. However, every passenger is covered during the tandem flight by third-party liability insurance.

 

The pilot's performance starts with connecting the passenger to the glider system before take-off and ends with disconnecting the passenger after landing.

 

The passenger is liable for any damage caused to the pilot or other persons, property or third parties as a result of the passenger's negligence or failure to follow the pilot's instructions.

 

Andres Villamizar Ardila: Salzburg Paragliding, or the pilot (named in the contract of transportation) is only liable to pay compensation if the damage was caused intentionally or through gross negligence by an act or omission of the pilot. Liability is not given if the pilot took all necessary measures to prevent the damage or if these measures could not be taken. The pilot's liability is limited to the amount of coverage insurance taken out for the flight. Further claims can only be made in the event of willful intent or gross negligence.

 

Andres Villamizar Ardila: Salzburg Paragliding and the service provider (pilot) are not liable for any personal injury or property damage that may occur during transportation to the activity, at the meeting point, during preparation and instructions near the take-off site, or while walking away from the landing site.

 

Exclusion or limitation of liability also applies to employees, Service providers (tandem pilots), and authorized representatives of Andres Villamizar Ardila: Salzburg Paragliding.

 

The flight may be subject to change. Failure to comply with the pilot's instructions and incomplete or inaccurate information regarding any part of the contract, can result in the loss of insurance coverage and endanger the health and property of persons involved and third parties. In such cases, the pilot has the right to exclude the passenger from the flight, which means that the entitlement to the service is forfeited. The full flight fee is applicable and there is no claim for a refund.

 

6. Dates and implementation

Andres Villamizar Ardila: Salzburg Paragliding offers tandem paragliding flights throughout the year. Restrictions may apply due to weather conditions and the operating hours of the mountain railways or Austrian air space. To schedule an appointment, you can contact us by phone, email or use the online booking form.

 

It should be noted that tandem flights are subject to weather conditions, and therefore, fixed dates do not guarantee the flight. In case of postponement or short-term cancellation due to weather conditions, compensation, reimbursement, or other expenses will not be provided. However, the flight can be rescheduled. Andres Villamizar Ardila: Salzburg Paragliding will inform the passenger as soon as possible about the feasibility of the flight.

 

Cancellations due to weather conditions do not require objective evidence. The subjective impression of the pilot in charge is sufficient.

 

The duration of the flight cannot be guaranteed due to varying weather conditions. The information shown on the services is an estimate of the flight time. The actual duration may vary significantly depending on weather conditions and maneuvers.

 

The passenger is obliged to follow the instructions of the pilot during take-off, in-flight and landing procedures.

 

7. Prices

The prices listed on the website and the invoice/ticket are tax-free according to paragraph (§ 6 Abs. 1 Z 27 UStG) small business sector.

 

Prices may vary at the beginning of a new year. Subject to the market condition.

 

8. Terms of payment

Payment can be made in cash/card on-site (the day of the flight) by invoice or by card when booking online or ordering a voucher on the website on our standard terms and conditions.

 

9. Cancellation terms

• Full Refund: Cancellations made 1 day (24 hours) or more before the scheduled flight will receive a full refund.

• 50% refund: Cancellations made within 2 hours of the scheduled flight will incur a charge of 50% of the total flight price.

• Cancellations made within 2 hours of the flight or 'no shows' are non-refundable.

10. Gift Voucher General Conditions

The following points outline the terms for purchasing and redeeming gift vouchers for our tandem paragliding services.

Purchasing a Gift Voucher:

Select Your Gift: Simply choose your preferred flight and a gift voucher amount that matches the total cost.

Fill in the Details: Provide the necessary information, including any personal message you wish to add for the recipient.

Complete Your Purchase: After finalizing your payment, a confirmation email with the unique voucher code, total value, and expiration date will be sent to the recipient.

Redemption:

Vouchers are valid for tandem paragliding flights and services offered exclusively on the Salzburg Paragliding website. They cannot be redeemed for cash, and are not a debit or credit card.

• Transferability: Gift vouchers are fully transferable. However, the flight participant must meet all safety requirements, including minimum age and weight limits (6+ years old, 20-115 kg), and they must have no cardiovascular or nervous diseases and must be sober.

• Flight ticket: A Fulfilled and signed Flight ticket is required from all participants before the flight, which is a standard procedure for all tandem paragliding flights in Austria.

Booking & Validity

• Booking Requirement: A gift voucher is not a flight reservation. The recipient must book a specific date and time for their flight on our website using the unique code provided.

• Validity Period: Vouchers expire 5 years from the date of issue. The flight must be booked and flown before this expiration date. The validity can be extended for an additional 5 years for a fee of 15% of the voucher's value.

• Price Guarantee: The price of the gift voucher is guaranteed for one year from the date of issue. This means there will be no additional cost to the recipient, even if the flight price changes within this period.

• Weather Conditions: All flights are dependent on favorable weather. If a flight is canceled due to weather, the voucher's validity remains unaffected. The recipient must simply reschedule the flight at no extra cost.

Redemption & Balance

• Redemption Process: To redeem, simply enter the unique voucher code at checkout.

• Partial Use: If the total purchase value is less than the voucher's value, the remaining balance can be used for future purchases of our services.

• Price Adjustments: If the price of a tandem flight has been updated since the voucher was purchased, the difference must be paid by the participant at the time of redemption or after the flight.

Cancellations

• Recipient Cancellation: Once a flight is booked using a voucher, our standard booking cancellation policy applies to any changes or cancellations made by the recipient.

 

Right of Withdrawal

The right of withdrawal is a legal right for all consumers in Europe. You have the right to cancel your voucher purchase within 14 days from the date of the contract's conclusion without needing to give a reason. You can exercise this right by sending us a clear statement in writing via post or email before the 14-day period ends.

Important Note: This right of withdrawal does not apply to a specific flight booking. Once a flight is scheduled for a fixed date and time using the voucher, that booking is considered a contract for a leisure activity with a specific fulfillment period and no longer falls under the right of withdrawal.

 

Consequences of Withdrawal

 

If you choose to withdraw from your voucher purchase, we will refund all payments we have received from you, including the standard delivery costs. This repayment will be processed promptly and no later than 14 days from the day we receive your withdrawal notification. We will use the same payment method you used for the original purchase, and you will not incur any fees for this refund.

 

11. Right to use image and film material

The passenger expresses his consent to the free use of photos and films taken during the flight by Andres Villamizar Ardila: Salzburg Paragliding or the service provider (pilot) for advertising purposes, etc. Even if the passenger appears in them, no costs will be incurred. 

 

12. Risk instruction

It should be noted that even with the utmost care and optimal flight, accidents with serious consequences such as sprains, broken bones, cervical spine contusions, spinal column injuries, concussions, and in extreme cases, death, cannot be completely avoided when paragliding. The risk is particularly increased during take-off and landing due to incorrect landings, occurrences, or falls. We make every effort to minimize this risk. The passenger must comply with the pilot's instructions during takeoff, landing, and throughout the flight. The passenger is confirmed to be in good physical and mental condition.

 

13. Final Provisions

All disputes arising from this contract and the Terms and Conditions will be governed by and construed by the laws of Austria.

 

If any provision of these Terms and Conditions is held to be ineffective or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. In place of the invalid or unenforceable provision, a provision that is as close as possible to the original intention of the parties shall apply.
